Hervey Bay, Property and the Law
Hervey Bay property is well priced compared to other parts of coastal Australia and many newcomers to the area are delighted with what their money can buy. However, Queensland has its own unique property laws which are considerably different from those which apply elsewhere. A classic example of the difference between jurisdictions is people incurring Stamp Duty problems when signing a Contract in their name with the intention of later changing to a Nominee (and / or Nominee is not acceptable practice in Queensland).
Property transactions typically settle within 30 days (or less!) and standard Contracts are written so that "time is of the essence". This means that if you agree in a Contract to do something by a certain time, there is no automatic right to extensions!
Cooling Off in Queensland
Recent changes in Queensland legislation mean that you, the buyer, are protected more than ever. A Government Warning Statement must now be included on the front page of all Residential Sales Contracts. You must sign the Warning Statement before you sign the Contract. The Warning Statement recommends that you seek independent legal advice before signing and also advises whether or not a cooling off period applies.
Once the Contract has been signed by both the Buyer and Seller it is binding. There is no 'exchange' of Contracts as is common in other States of Australia. This can be confusing - and dangerous - for those who have no experience with the Queensland system.
You are entitled to a 5 day cooling-off period if you take part in a property information session or meeting as a result of an unsolicited invitation from a real estate agent or developer. An unsolicited invitation occurs when the agent or developer initiates the contact with you. For example, if you receive a letter from the agent or developer addressed to you personally or an agent or developer approaches you at your house, in the street or at a shopping centre. The cooling-off period is designed to let you think about the purchase and allows you time to consult your solicitor and financial advisor.
